If you’re a highly skilled professional or academic looking to move to the United States but feel held back by age, English language tests, or the lack of a job offer, there’s now a clear path forward. The National Interest Waiver, or NIW, under the EB-2 immigration category offers a flexible route to a U.S. green card without many of the typical barriers.
As of May 2025, this self-petition option continues to gain global attention—and from June 2025, new changes are making it even more accessible. One of the biggest advantages is that there’s no requirement to take language exams like IELTS or TOEFL. While strong communication skills are beneficial, there’s no need to prove proficiency through formal testing.
Approval also grants green card eligibility not only for the applicant but also for immediate family members, including a spouse and children under 21. Another major benefit is the absence of an age limit. Whether you’re in your late 20s or well into your 50s, you’re eligible to apply.
Unlike many other U.S. immigration categories, the NIW doesn’t require a job offer or employer sponsorship. Applicants can petition for themselves, eliminating the need to go through the lengthy labor certification (PERM) process.
To qualify, you’ll need to meet one of two basic requirements: either hold an advanced degree (a master’s or its equivalent, or a bachelor’s with five years of progressive experience), or demonstrate exceptional ability in a field like science, business, or the arts. In addition, you must satisfy three key criteria: your work must have substantial merit and national importance, you must be well-positioned to carry it out, and it must be clear that waiving the job offer and labor certification would benefit the U.S.
From June 2025, newly recognized fields have been added to the list of areas eligible for streamlined consideration. These include artificial intelligence, renewable energy, public health, cybersecurity, climate science, and biotechnology. Applications in these areas may receive more favorable and quicker review.
Premium processing has also been introduced for NIW petitions. By paying an expedited fee, applicants can now receive a decision on their I-140 petition within 45 calendar days, significantly reducing the usual waiting period. On top of this, the latest visa bulletin shows forward movement in EB-2 priority dates for many countries, meaning green cards may be issued faster after approval.
This pathway isn’t just limited to researchers or tech professionals in the U.S.—it’s open to qualified applicants around the world who are making meaningful contributions in fields that align with America’s national interests.
To apply, gather your academic and professional records, prepare a detailed petition that outlines your work and its broader impact, and file Form I-140. Those already in the U.S. can also file Form I-485 for adjustment of status, while those outside can go through consular processing.
