The proposed legislation seeks to strengthen national security, regulate immigration processes, and impose stricter penalties on foreigners violating entry and residency conditions.
The bill requires individuals entering or leaving India to possess a valid passport and visa. Foreigners staying in the country must maintain valid documentation unless exempted under specific provisions. Those deemed a threat to national security, sovereignty, or territorial integrity will be denied entry or permission to remain in India.
Foreign nationals will be required to register upon arrival, with restrictions placed on their movement, name changes, and access to protected or restricted areas. Educational institutions, hospitals, and nursing homes must report the registration of foreign nationals to immigration authorities.
Individuals holding dual citizenship will be considered citizens of the country whose passport or travel document was used to enter India if checked by immigration officers.
Violations of these provisions will result in strict penalties. Entering India without a valid passport or visa may lead to imprisonment of up to five years and a fine of up to five lakh rupees. The use of forged documents may result in imprisonment ranging from two to seven years, with fines between one lakh and ten lakh rupees.
Overstaying, violating visa conditions, or trespassing in restricted areas could lead to imprisonment for up to three years and a fine of up to three lakh rupees. Transport carriers bringing foreigners without valid documents will be liable for fines of up to five lakh rupees and may face the seizure of their transport if penalties are unpaid. If a foreigner is denied entry, the carrier will be responsible for their immediate removal from India.
The bill grants immigration officers the authority to arrest individuals without a warrant and empowers the central government to regulate the movement of foreigners. Individuals may be restricted from leaving the country if required by an authorized agency.
